What personal information do we collect?

We collect the following personal information:

  • Your first name, surname, email address and mobile phone number, when you first register an account with us.
  • Your address details (street and house number, further lines of your address if necessary, post code and landline telephone number) when you make an order with us. A billing and a delivery address are both required, but these may be the same location.

We store a cookie on your computer in order to recognise you and remember your basket choices you make while not logged in. As soon as the session finishes, this cookie becomes unnecessary and is deleted. No personal information is stored within the cookie.

We automatically receive such information as your IP address, the URLs of sites from which you arrive at our web site, your type of browser and ISP; this is a normal logging function performed by our server. Your personal information is not linked to your IP address, the referring web site (if any) or indeed any other information about your computer.

 

How do we use your personal information

We use the information you provide to:

·         Administer your account with us and customize the service we provide to you. For example, we greet you with your first name and use your email address as a way of identifying you as you log in.

·         Because we use a secure payment service, at no time does your credit or debit card information reach our server. We do not store this information.

·         Your delivery address and contact telephone numbers are provided to our courier company, so that they can deliver your order efficiently and contact you if there is a problem.

·         We will never sell, rent or otherwise provide your personal, identifiable information to any third parties for marketing purposes.

 

Control over your personal information

You may:

·         Review and change your personal information through your Personal details page

·         Change the email address at which we contact you (and with which you log into our site)

·         Request that we close your account.

 

Security

Your personal information is secured with industry standard security technology between your browser and our server.

Terms & Conditions

Your use of this Website (www.annikasfavourites.com.au) and the Service means that you accept the following Terms and Conditions and Privacy Policy, which are legally binding.

Introduction

Annika’s Favourites is a private limited company registered in Australia ACN 134 854 103.  Our registered offices are 15A Oswald Street , Elsternwick, VIC 3185. We manufacture and deliver baby products which are available for purchase on our Website ("the Service") and stores across Melbourne and Geelong. In these Terms and Conditions references to "We", "Us", "Our" and any similar expression shall include the Company and any of its affiliates. These Terms and Conditions are to be entered into between Us and the customer ("You").

Effect of these Terms and Conditions

Your use of this Website means that you are subject to the following Terms and Conditions. The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

Registration

Before You are able to use Our Service, You will be required to register with Us by completing the registration form on Our Website (www.annikasfavourites.com.au). For security purposes, You will be required to choose a Password, which You must keep private and secure at all times. Failure to do so, could lead to unauthorised activity on your account.

Payment

We accept payment via Credit Card or PayPal. Deliveries will only be dispatched once We have received and cleared your payment.

When paying by credit card, We will debit your card on receipt of order.

Please note, that should your order include anything out of stock on the dispatch date, We will contact You by telephone and offer an alternative product which is equivalent to your order. If the alternative is not acceptable to you, We will refund the value of the undelivered product(s). Should We be unable to contact You to advise of a shortage of stock, We will send all items which are available and We will automatically reimburse You for the item which was out of stock.

Delivery

We send our orders, in good faith, via a reputable courier service to be with You [between 10.30am and 5.30pm] ("the Delivery Period") on the day of delivery.

We work closely with the carrier to ensure orders are delivered on time, however we cannot be held responsible for unforeseen delays encountered by the carrier.

Delivery of goods will only be attempted once and to the original delivery address supplied. We operate a signature optional policy so you do not need to be present to receive your order.

You will be requested to select a 'if not at home option' when you order instructing the driver where leave your goods if you are not present (e.g. with your neighbour, on door step). This is set at 'leave on doorstep' unless you offer an alternative.

All orders are packed with dry ice gel packs which will keep them frozen until 6pm on the day of delivery. We do however advise all customers to check each item they have ordered thoroughly before placing them in the freezer, this procedure is especially important if you receive your order later than expected.

You are reminded of the perishable nature of the goods, if someone other than yourself is receiving the order on your behalf, please make sure that they are aware of how you would like your items to be handled once delivered.

If a problem occurs in relation to your goods, which is not the fault of Annika’s Favourites, we are not at liberty to compensate.

You hereby acknowledge and agree that the goods are perishable in nature and that where the goods are required to remain frozen, You will place the goods in a freezer immediately on delivery.

We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether.

Please note adverse weather conditions or other events outside of Our reasonable control may result in the occasional late or cancelled delivery of your order. We will at all times endeavour to contact You as soon as we are able to, in order to reschedule your delivery time and date. In any event our liability to You will be limited to the price of goods not delivered and the cost of delivery.

 

Cancellation of Order

You have the right to cancel any order which You have placed with Us, before 10.00am on the day prior to delivery. This can be done by email or phone and will be acknowledged by Our customer services team. We will refund any payment You have made, but We reserve the right to make a charge of 5% to cover the costs incurred by Us handling your payment/credit.

Annika’s Favourites Baby Food Guarantee - Refunds

At Annika’s Favourites we pride ourselves on providing top quality baby food. If, in your judgement a comparable baby food dish, tastes better than one of ours, please contact us and we will arrange a refund for that/those dishes.

Annika’s Favourites reserves the right to withhold refunds but will do so only in cases which it feels are not genuine.

Our Liability

No liability will be accepted by the Company for any delay in performance of the contract or failure to perform Our obligations with the Customer, if that delay or failure to perform is wholly or partially due,but not limited, to any of the following: Act of God, War, Acts of Terrorism, Fire, Civil Commotion, Restriction by Government or other competent authority, Strike, Riot, Accident, Failure in supplies or to any cause whatsoever beyond our control. In such an event, We reserve the right to cancel or suspend Our Service without incurring any liability to You.

In any event, and notwithstanding anything contained in these Terms and Conditions (except in the case of fraud), Our liability in contract, tort (including negligence or breach of statutory duty) or otherwise by reason of or in connection with these Terms and Conditions (except in relation to death or personal injury caused to You by Our negligence) shall be limited to the price paid for the goods and the cost of delivery of those goods. Nothing in these Terms and Conditions will restrict any of your statutory rights.

Complaints Procedure

If despite Our best efforts You do have a complaint, please email Us at katie@annikasfavourites.com.au giving Us as much information as You can about your complaint. We will endeavour to acknowledge your complaint by the next working day and to resolve your complaint within 5 working days.

Customer Support

You may call Us on 03 9596 7260 between 9.00am and 5.00pm. Outside office hours there is a voicemail service. We will aim to respond to your call within 24 hours (except weekends/public holidays). Alternatively You may email Us at katie@annikasfavourites.com.au.

Personal Details

We do not and will not pass on any details about You to any person not directly employed by Us, unless required to do so by the law. The exception is when we take steps to confirm security of a debit/credit card transaction. Delivery information will be disclosed to a delivery or courier service, including contact telephone details.

Our Rights

We reserve the right to:-

·         change, modify, substitute or remove any item, without prior warning, on the Website.

·         change Prices, goods and availability of products at any time.

·         refuse service to any customer; and

·         amend these terms and conditions without notice.

Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance, new facilities or services or repair or for reasons beyond our control. We shall not be liable for any costs which You may incur.

General

These Terms and Conditions constitute to the fullest extent permitted by law the whole of the agreement between You and the Company with regard to the use of the Website and the Service.
